Massachusetts Law Review Publishes Pole Attachment Article by Rich May’s Harold Dondis and James Behnke
The Fall 2004 issue of the Massachusetts Law Review features an article by Rich May attorneys, Harold Dondis and James Behnke, which discusses the roles of takings, easements, licenses, leases and irrevocable rights to use under the federal and state Pole Attachment Acts. Throughout the article, Mr. Dondis and Mr. Behnke “[argue] for an interpretation of the PAA and MPAA that safeguards the property rights of landowners and yet preserves in practice the state and federal constitutionality of these laws with an administrative agency rather than a jury determination of ‘just compensation.’ In doing so, [the] article attempts to accommodate pole attachments and so-called Irrevocable Rights to Use property, within the terms of common law property concepts,” (Behnke, J.M. & Dondis, H.B., 2004).
